On October 23, 2026, Anthony Marino obtained a defense verdict in a premises liability case after a one week trial in Supreme Court, Nassau County before Justice Erica L. Prager. The claim was made by a plaintiff who was a student at one of our university clients and alleged to have tripped and fell on a walkway due to a defect that measured two feet by one foot with a depth of two to three inches. As a result, the plaintiff alleged injuries to her ankle and neck, both of which required surgical intervention. At trial, it was argued that the condition was open and obvious, the walkway was in a reasonably safe condition and there was no notice. After deliberating for an hour and ten minutes, the jury found the walkway to be in a reasonably safe condition and returned a verdict the defendant university.
