On May 12th, 2026 Alan J. Fumuso obtained a Defense Verdict in Supreme Court Nassau County before the Honorable Lisa Cairo. The case was brought by a then 39 year old woman who alleged that she sustained permanent nerve damage in her left leg and foot as a result of an operation by the defendant plastic surgeon to remove multiple lipomas. She alleged that the surgery was performed in a negligent manner, and that she did not give an Informed Consent.
The trial lasted two weeks with plaintiff’s attorney calling multiple medical experts in the fields of Plastic Surgery, Neurology and Electrodiagnostic Medicine. The Defense countered with experts in the fields of Plastic Surgery and Neurology/Electrodiagnostic Medicine.
The jury deliberated for an hour, and returned a unanimous verdict on behalf of the defense on both causes of action.
